Terms & Conditions of Sale
These Terms & Conditions apply to consumer purchases of products through the Hoopshoppen webshop.
Purchases are governed by these Terms & Conditions, the information provided during checkout and any separately agreed terms. Mandatory consumer rights under Norwegian law are not limited by these Terms & Conditions.
1. Seller Information
The seller is:
Hoopshoppen /Julie Karll Drejstel
Marselis Gate 35A
H0101
0551 Oslo
Norway
Email: info@hoopshoppen.com
Additional company information, including the organisation number, is provided on the website where applicable.
2. Prices
Prices are displayed in the currency applicable to the country or region selected or detected on the website.
The total price payable will be shown before the order is placed and will include applicable taxes and any additional charges required for the purchase. Delivery costs, where applicable, will be clearly displayed during checkout before the order is confirmed.
Currency conversion may cause prices to vary between countries or regions.
3. Placing an Order
An order becomes binding when it has been submitted through the webshop, subject to applicable Norwegian consumer law.
After placing an order, an order confirmation will be sent to the email address provided during checkout.
If an obvious pricing, typing or technical error has occurred and the customer knew or reasonably should have understood that the information was incorrect, the order may not be binding.
Customers are encouraged to check the order confirmation and contact Hoopshoppen as soon as possible if any information is incorrect.
4. Payment
Available payment methods are displayed during checkout and may include Visa, Visa Electron, Mastercard, American Express, Discover, PayPal and direct bank transfer, depending on availability in the customer’s country.
For card payments, the amount will normally not be charged until the order is dispatched, unless otherwise clearly stated during checkout or required by the selected payment method.
Payments are processed through secure payment solutions designed to protect payment information during the transaction.
For custom-made hula hoops produced according to individual specifications, payment may be arranged by invoice sent to the email address provided by the customer.
5. Delivery
Orders are prepared and dispatched as soon as reasonably possible after the order has been received. The estimated delivery time within Norway is 2–5 business days.
Custom-made hula hoops require additional production time. The expected timeframe will be communicated as part of the ordering process.
Orders are dispatched from Norway. Available delivery methods and applicable shipping costs will be displayed during the ordering process and may vary depending on the destination.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
The risk of loss or damage to the goods generally remains with Hoopshoppen until the customer, or a third party designated by the customer other than the carrier, has physically received the goods, in accordance with applicable Norwegian consumer law.
6. Delayed or Missing Delivery
If an order is delayed or is not delivered as agreed, the customer may have the right to require delivery, cancel the purchase and/or claim compensation in accordance with the Norwegian Consumer Purchases Act (forbrukerkjøpsloven).
If a delivery is delayed, please contact Hoopshoppen at info@hoopshoppen.dk so the matter can be investigated.
7. Complaints and Defective Products
Consumer purchases are covered by the Norwegian Consumer Purchases Act (forbrukerkjøpsloven).
If a product has a defect that was not caused by the customer or by improper use, the customer may have the right to repair, replacement, a price reduction, cancellation of the purchase and/or compensation, depending on the circumstances and the requirements of applicable law.
A complaint must be made within a reasonable time after the defect was discovered or should have been discovered. A period of up to two months from discovery will always be considered timely.
The final complaint period is normally two years from delivery. If the product, or relevant parts of it, is intended to last substantially longer under normal use, the complaint period is five years.
If the complaint is valid, repair or replacement must be carried out without cost and without significant inconvenience to the customer, in accordance with applicable Norwegian law. Necessary return costs associated with a valid complaint will therefore be covered by Hoopshoppen.
Damage caused by misuse, improper handling, accidents, normal wear and tear or use contrary to relevant instructions is not considered a product defect unless otherwise provided by mandatory law.
To make a complaint, contact info@hoopshoppen.dk with the order details and a description of the issue. Photos may be requested where they can help assess the problem.
8. Repairs
Hoopshoppen offers the possibility of repairing hula hoops where repair is practical, for example if a connection mechanism needs to be replaced.
Where the issue constitutes a defect covered by the Norwegian Consumer Purchases Act, the remedies available under the Act apply, and any repair carried out as a remedy will be provided without cost to the customer.
If damage has been caused by improper use, accidental damage or ordinary wear rather than a product defect, a paid repair may be offered. Any applicable repair and shipping costs will be communicated before the repair is carried out.
9. Right of Withdrawal
Consumers generally have a 14-day right of withdrawal when purchasing goods online under the Norwegian Right of Withdrawal Act (angrerettloven).
For goods, the 14-day withdrawal period generally begins on the day the customer, or a designated third party other than the carrier, physically receives the goods.
If several goods from the same order are delivered separately, the withdrawal period generally begins when the last item is received.
To exercise the right of withdrawal, the customer must provide a clear statement of the decision to withdraw before the 14-day period expires. This can be done by contacting info@hoopshoppen.com or by using the statutory withdrawal form provided in connection with the purchase.
After notifying Hoopshoppen of the withdrawal, the goods must be returned without undue delay and no later than 14 days after the notification was given.
10. Return Costs When Exercising the Right of Withdrawal
11. Condition of Returned Products
The customer may inspect and handle a product to the extent necessary to establish its nature, characteristics and functionality, similar to what would normally be possible in a physical shop.
If the product has been handled beyond what is necessary for this purpose and its value has been reduced as a result, the customer may be responsible for the reduction in value, provided the legally required information about the right of withdrawal has been supplied.
Products should be returned securely packaged to help prevent damage during transport.
12. Refunds
When the statutory right of withdrawal is exercised, Hoopshoppen will refund payments received for the purchase, including the cost of the least expensive standard delivery option offered for the order.
Additional delivery costs resulting from the customer’s choice of a more expensive delivery method, such as express delivery, are not refundable beyond the cost of standard delivery.
The refund will be made without undue delay and no later than 14 days after Hoopshoppen has been informed of the decision to withdraw.
Hoopshoppen may withhold the refund until the returned goods have been received or the customer has provided documentation showing that the goods have been sent back, whichever occurs first.
Unless otherwise expressly agreed, the refund will be made using the same payment method used for the original transaction, without additional refund fees for the customer.
13. Custom-Made Products
The statutory right of withdrawal does not apply to goods made according to the customer’s specifications or products that have been given a clearly personalised character.
This may include custom-made hula hoops produced according to a customer’s individual choice of specifications or design.
The exception from the right of withdrawal does not affect the customer’s statutory rights if a custom-made product is defective, damaged or otherwise does not comply with the agreement.
Customers considering a custom-made hoop are welcome to get in touch before placing an order to clarify available options.
14. Returns and Complaints
Before returning a product due to a complaint, repair request or other issue, please contact:
Julie Karll Drejstel
Marselis Gate 35A
H0101
0551 Oslo
Norway
Email: info@hoopshoppen.com
This helps ensure that the return is handled correctly and as efficiently as possible.
15. Applicable Law and Consumer Rights
These Terms & Conditions are governed by Norwegian law to the extent applicable.
Nothing in these Terms & Conditions is intended to restrict or exclude mandatory consumer rights under Norwegian law.
For consumer purchases, relevant legislation includes the Norwegian Consumer Purchases Act (forbrukerkjøpsloven), the Right of Withdrawal Act (angrerettloven), the Marketing Control Act (markedsføringsloven) and the E-commerce Act (ehandelsloven).
